Proposed AI and cybersecurity legislation: August 23, 2025 - September 19, 2025

Some of this legislation should scare us sh**tless.
     When you read the not-so-boring details below, pay attention to H.Res.701. It’s a strong attempt to limit Trump’s power to grant doge unlimited access to our data. That should not have been a partisan bill. But it was. Only Democrats sponsored or cosponsored it. Not a single Republican signed on.

August 24, 2025 alert. Transcript of January 10, 2024 hearing released. “Harnessing AI to Improve Government Services and Customer Experience.” 
     Ahh, for the good old days when grownups were in the room! Was it really only nineteen months ago?
     Sen. Gary Peters, then-chair of the Senate Committee on Homeland Security and Governmental Affairs, opened the meeting with a rational statement. He pointed out areas where AI could indeed be beneficial, while also noting its dangers. Contrary to what many people on LinkedIn believe, I am not anti-AI. I am anti-AI when it steals intellectual property or accesses personal data.
     I agree with Sen. Peters. For example, a transcript of this meeting should have and could have been made available much earlier. AI is quite good at transcription. Use it for that!
     Also, since government documents are indeed public domain, hire an independent agency (not Grok or Meta or OpenAI) to train AI on documents in the congressional record. It would be amazing if not only the texts of proposed legislation, but also summaries thereof, were available much faster. Currently, texts often take weeks to upload to congress.gov, while summaries may not available for months, and transcripts for years!

September 3, 2025 meeting, announced August 27, 2025. 10:15AM(EDT) | 2123 Rayburn House Office Building, Washington, D.C. “Examining Opportunities to Advance American Health Care through the Use of Artificial Intelligence Technologies.”
     Grownups are no longer in the room, except for Democrats. Transcript of this meeting is not yet available. However, if you’re interested, the video of the meeting is indeed available. The committee also uploaded documents that were discussed during the meeting – not just a list of documents, but the documents themselves.
     Luckily for us as American citizens, it’s not just spineless Republicans like John Joyce (R-PA) who sit on this committee. Alexandria Ocasio-Cortez (D-NY), Frank Pallone (D-NJ), and Debbie Dingell (D-MI) also do.

S.2714 - CHAT Act (Children Harmed by AI Technology Act). To require artificial intelligence chatbots to implement age verification measures and establish certain protections for minor users.
     Introduced September 4, 2025 by Jon Husted (R-OH), this bill has no cosponsors.
     Comment: Because chatbots are soooo good at online identification. Sigh.

H.R.5045 - HEALTH AI Act (Healthcare Enhancement And Learning Through Harnessing Artificial Intelligence Act). To direct the Secretary of Health and Human Services to establish a grant program to facilitate research regarding the use of generative artificial intelligence in health care.
     Introduced August 26, 2025 by Ted Lieu (D-CA). Cosponsored by Ami Bera (D-CA).
     Permissible research.—Research funded pursuant to a grant under this section may include research regarding the use of generative artificial intelligence to—
     (1) improve the ability of health care practitioners to record comprehensive notes or ask medically relevant questions during an appointment with a patient;
     (2) reduce the administrative or documentation burden on clinicians;
     (3) expedite the health insurance claims process;
     (4) improve the efficiency and quality of customer service in the health care sector; or
     (5) otherwise improve health care, as determined appropriate by the Secretary.
     Comment: I would feel better about this bill if RFK, Jr. were not Secretary of HHS. Can they postpone?

H.R.5150 - Protecting Agricultural Borrower Information Act. To strengthen privacy protections for recipients of loans and payments processed by the Farm Service Agency.
     Introduced September 4, 2025 by April McClain Delaney (D-MD). Seven Democratic cosponsors, no Republicans.
     Comment: This is a recurring theme. Democrats seek to protect our data from the Executive Branch (the Secretary of Agriculture and the Farm Service Agency) by making it illegal to provide our personal information when submitted for loans granted by the Farm Service Agency or Department of Agriculture. Republicans stifle those attempts at data privacy.

H.R.5173 - No Social Media at School Act. To require social media companies to use geofencing to block access to their social media platforms on K-12 education campuses.
     Introduced September 8, 2025 by Angie Craig (D-MN). No cosponsors.
     Comment: Uncomplicated bill. Social media companies use geofencing to spam us with e.g., advertisements for Panera Bread or Buc-Eez when you’re within a certain distance of their nearest establishment. Companies who use Microsoft’s time tracking or timeclock apps use geofencing to determine whether an employee is inside the building when they clock in.
     Why can’t Meta and TikTok likewise use geofencing to block access when kids are in school?

S.2766 - Consumer Safety Technology Act. To direct the Consumer Product Safety Commission to establish a pilot program to explore the use of artificial intelligence in support of the mission of the Commission and to direct the Secretary of Commerce and the Federal Trade Commission to study and report on the use of blockchain technology and tokens.
     Introduced September 10, 2025 by John Curtis (R-UT). Cosponsored by Lisa Blunt Rochester (D-DE).
     Comment: This is a very long bill. Frankly, I am disappointed that it has any Democratic support. Let’s legislate guardrails before we enable AI further!

H.R.5243 - To amend title XVIII of the Social Security Act to increase data transparency for supplemental benefits under Medicare Advantage.
     Introduced September 10, 2025 by Jennifer McClellan (D-VA). No cosponsors.
     Comment: Section 1, B, iii, calls for confidentiality of all files. Fat chance.

September 4, 2025 alert. September 10, 2025 meeting. 10:00AM(EDT) | 253 Russell Senate Office Building, Washington, D.C. “AI’ve Got a Plan: America’s AI action plan.” The almost-two-hour video is available for viewing. However, transcript is not yet available, nor is list of “witnesses” or documents presented. I started watching it. But could not stomach it. It’s butt-kissing for President Trump. There’s no sense of danger around what they are contemplating.
     My hopes are also diminished because Ted Cruz (R-TX) is chair of the Senate Commerce, Science, and Transportation Committee, and Ted Budd (R-NC) is chair of the Science, Manufacturing, and Competitiveness that held this particular hearing.

H.Res.701 - Of inquiry requesting the President of the United States to furnish certain information to the House of Representatives relating to the Department of Government Efficiency's access to and usage of NUMIDENT and other personally identifiable information in the possession of the Social Security Administration.
     Introduced September 11, 2025 by John Larson (D-CT) with eighteen Democratic cosponsors and no Republicans. The resolution asks:
     That the President of the United States is requested to furnish the House of Representatives, not later than 14 days after the date of adoption of this resolution, copies of any document, record, audio recording, memorandum, call log, correspondence (electronic or otherwise), audit trails and audit logs, written agreements, or other communication in his possession, or any portion of any document, record, audio recording, memorandum, call log, correspondence (electronic or otherwise), or other communication, that refers or relates to the following:
     (1) The development of a cloud environment that hosts a copy of the Social Security Administration’s Numerical Identification System (hereafter referred to as “NUMIDENT”), including risk assessments and security protocols.
     (2) The purpose of creating a cloud environment that hosts a copy of the NUMIDENT, including whether the copy will be used to:
     (A) conduct Federal audits and investigations;
     (B) restrict or deny Social Security benefits, Medicare coverage, or any other benefits;
     (C) develop a centralized database for the Federal Government that compiles citizens’ personal information across Federal agencies and departments;
     (D) sell or make available information contained in the copy for private purchase; or
     (E) train and enhance artificial intelligence.
     (3) Access to, and usage of, NUMIDENT information hosted in such cloud environment by Edward Coristine, Aram Moghaddassi, John Solly, Michael Russo, or any other individual, including those acting for or on behalf of the Department of Government Efficiency (hereafter referred to as “DOGE”).
     (4) Access to, and usage of, personally identifiable information inside the Social Security Administration’s Enterprise Data Warehouse on or after March 14, 2025, by Payton Rehling, Aram Moghaddassi, or any other individuals acting for or on behalf of DOGE.
     Comment: The fact that this was referred to the House Ways and Means Committee, with no action whatever in the past two weeks, demonstrates how firmly the House is in Trump’s pocket. This should be a no-brainer.
     The only way this will move forward? If the data of Mike Johnson or Ivanka Trump is compromised. Then you will hear yelling about data privacy.

H.R.5388 - - American Artificial Intelligence Leadership and Uniformity Act. To provide a national framework to sustain American leadership in artificial intelligence, to require an actionable Federal plan aligned to that policy, and to establish a temporary moratorium preempting certain State laws that restrict artificial intelligence models and systems engaged in interstate commerce.
     Introduced September 16, 2025 by Michael Baumgartner (R-WA). No cosponsors. 
     Comment: No cosponsors, otherwise I would be more worried about it.

S.2866 - Cybersecurity in Agriculture Act of 2025. To amend the National Agricultural Research, Extension, and Teaching Policy Act of 1977 to direct the Secretary of Agriculture to establish a program providing for the establishment of Agriculture Cybersecurity Center.
     Introduced September 18, 2025 by Ted Budd (R-NC). Cosponsored by Catherine Cortez Masto (D-NV), Adam Schiff (D-CA), and Jim Banks (R-IN).
     Comment: I wonder what Cortez Masto and Schiff traded for their cosponsorship of this bill. Instructive that not a single Democratic senator from an agricultural state wanted this. 

H.R.5511 - Algorithmic Accountability Act of 2025. To direct the Federal Trade Commission to require impact assessments of certain algorithms.
     Introduced September 19, 2025 by Yvette Clark (D-NY). Twenty-one Democratic cosponsors. No Republicans.
